Terms of Service

By creating an account or otherwise using Swimbait Hero (the “Service”), you agree to these Terms of Service (“Terms”). If you don't agree, please don't use the Service.

Swimbait Hero is a catalog and community tool for tracking swimbaits you own or want, sharing photos of your catches, and connecting with other collectors and anglers. Part of the Service lets users list items as for-sale or for-trade and send offers to one another.

The Service does not process payments, hold funds, ship items, or take part in any trade or sale in any way. It is strictly a tool for two users to find each other and agree to terms — every actual exchange of money or goods happens entirely off-platform, directly between those users.

You must be at least 18 years old to use the Service.

You're responsible for keeping your account credentials secure and for all activity that happens under your account. Let us know right away if you believe your account has been compromised.

Any trade, sale, or other exchange you arrange with another user through the Service is strictly between you and that other user. We are not a party to it, we do not mediate it, and we do not guarantee that any offer, trade, or sale will be completed, that an item matches its description, or that the other user will follow through.

You are solely responsible for vetting who you deal with, verifying items before completing an exchange, choosing how you send or receive payment, and how you carry out any in-person or mail exchange. We strongly encourage using safe, traceable payment methods and, for in-person exchanges, meeting in public places.

We are not responsible for any loss, damage, fraud, non-delivery, or dispute arising from a trade or sale arranged through the Service, including money or items that change hands off-platform.

You keep ownership of the photos, notes, and other content you upload. By posting it, you give us a license to display it within the Service (for example, on your profile, in catch feeds, and in listings). You're responsible for making sure you have the right to post whatever you upload, and for what it shows.

Don't upload content that's illegal, infringes someone else's rights, or that you don't have permission to share.

Swimbait model information and manufacturer photos shown in the catalog are sourced from makers' and retailers' own public listings and remain the property of their original owners. See our Image & Content Disclaimer for details.

You agree not to:

• Use the Service for anything illegal, fraudulent, or to list stolen or illegal items;
• Harass, impersonate, or deceive other users;
• Attempt to bypass rate limits, scrape the Service at scale, or interfere with its normal operation;
• Use another person's account without permission.

We may suspend or terminate accounts that violate these Terms.

The Service is provided “as is” without warranties of any kind. We don't guarantee it will be uninterrupted, error-free, or that catalog data is fully accurate or current.

To the fullest extent permitted by law, Swimbait Hero and its operator won't be liable for any indirect, incidental, or consequential damages arising from your use of the Service, including any loss connected to a trade, sale, or exchange arranged with another user.

We may update these Terms from time to time. If we make material changes, we'll update the date above. Continuing to use the Service after changes take effect means you accept the updated Terms.

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules.
